Protected workshops and protected workplaces represent tools of the pro-active employment policy which seeks to provide working opportunities for handicapped persons.
Protected work position is a position created by an employer for a handicapped person based on a written agreement with the Employment Office. A protected work position shall be operated for at least 2 years after the date specified in the agreement. The Employment Office may provide a financial contribution for the creation of the protected work position.
Protected workshop is a workplace of an employer, identified and based on the agreement with the Employment Office and adapted to meet the needs for employment of handicapped persons, which employs at least 60% of handicapped employees, based on the average converted number of employees. A protected workshop shall be operated for at least 2 years after the date specified in the agreement. The Employment Office provides a financial contribution for the creation of the protected workshop.
Employer employing more than 50% of handicapped people. In order to determine the total number of employees, handicapped employees and employees with a severe handicap, the decisive number is the average converted number of employees in the calendar quarter. The method of calculation of the average converted number of employees and handicapped employees in the calendar quarter shall be determined by the ministry in an implementing legal regulation. Employers employing more than 50 % of handicapped persons from the total number of employees shall receive a contribution to support the employment of such persons. The competent Employment Office to provide the contribution is the office in the district of the registered address of the employer (legal person) or the residential address of the employer(physical person).
Handicapped persons are physical persons:
A person disadvantaged due to their health condition is a physical person with a functional health disorder, that makes it possible for the person to perform systematic work in employment or another form of gainful occupation, but the ability of the person to participate in the working process, perform the previous profession or use the existing qualification or acquire a qualification, has been significantly limited as a result of his /her long-term poor health condition. The fact of being a handicapped person shall be documented by the physical person with a certificate or resolution issued by the social security authority.
